General terms and conditions of the Menucia service

1. Operator

These terms and conditions govern the rights and obligations between Belleza SK sro, Company ID: 50730941, Tax ID: 2120447835, VAT ID: SK2120447835, with registered office at Jenisejská 1432/43, 040 12 Košice – Nad jazerom (hereinafter referred to as the “Operator”) and each natural or legal person who uses the Menucia services (“Member” or “User”). The Operator is registered as a VAT payer pursuant to §7a of the Value Added Tax Act.

2. Definitions

• Menucia service: a digital web platform (SaaS solution) used to create, manage and present menus, daily menus and price lists of establishments via QR codes, web links and exportable printing.
• User: a business entity that creates an account on the Menucia platform and uses one of the offered pricing plans.
• Plan: the range of features and services available for a specified time frame, defined as FREE, BASIC, or PREMIUM.

3. Account creation and access to the service

Registration takes place via an electronic form on the Menucia website. After registration, the User is entitled to access the administrative interface, in which he can create and edit his own digital currency. The Operator reserves the right to refuse registration in case of false data or violation of the previous terms.

4. Scope and functionality of the

Menucia service provides Users with a menu management platform, which includes: creation and editing of menus, daily menu, overview of food photos, allergen information, setting of opening hours, export to print (PDF) and output for the web. Functions are made available depending on the selected subscription.

5. Subscription and payment terms

Use of the Menucia platform is subject to a subscription fee in the form of a monthly or annual flat rate. Prices are listed including VAT and are publicly available on the website www.menucia.com . Payments are processed through the secure payment system Stripe.

After payment of the fee, the respective plan is activated for a period of 30 (or 365) days from the date of payment.

6. Trial period and withdrawal from the contract

Each User has the opportunity to use the FREE version without time limit. In case he activates the paid BASIC or PREMIUM plan, he has the right to request withdrawal from the contract within 30 calendar days without giving a reason. In such case, the payment will be refunded in full in the same form as it was received.

7. User Responsibilities

The User is responsible for:

• the truthfulness and timeliness of the published data in the menu,
compliance with legislation (especially in the area oof allergen information, prices and customer protection), securing your account from misuse.

The Operator is not responsible for the content created by the User.

8. Availability and technical support

The Menucia system is available 24/7 with a guaranteed availability of at least 99%. The Operator reserves the right to perform regular maintenance, of which the User will be informed in advance. Support is provided by e-mail, and for Premium Users also on a priority basis.

9. Personal data protection (GDPR)

Belleza SK sro as the operator is the controller of personal data within the meaning of the GDPR. All personal data is processed only to the extent necessary to provide the service. Details are set out in the Personal Data Protection Policy document , which is available on the website.

10. Termination of the contract and cancellation of the account

The User may request cancellation of the account at any time by e-mail or directly in the profile settings. The Operator reserves the right to terminate the service to a User who violates these terms and conditions or whose activities are contrary to good morals or the law.

11. Changes to the Terms and Conditions

The Operator reserves the right to change these Terms and Conditions. The current version will always be published on the website www.menucia.com . The User will be informed of the changes via e-mail or notification in the system.

12. Final Provisions

These Terms and Conditions are governed by the laws of the Slovak Republic. Any disputes arising in connection with these Terms and Conditions will be resolved before the competent court in Košice.
